Fairbanks County, 911. Where's your emergency? [00:57] Hello, Fairbanks County, 911. [01:00] That few seconds of 911 call that came into Fairfax County might not sound like a lot. [01:06] I mean, the caller hung up right where it cut off after that groan. [01:09] So it tells a first-time listener almost nothing. [01:13] But that call would turn out to be [01:16] Everything.

[01:17] Prosecutors say those few seconds are among the strongest pieces of evidence that a man named Joseph Ryan was murdered. [01:25] And if that's true, then he was lured there and executed as part of the same plan [01:31] that got Christine Banfield killed. [01:33] You can be the judge. [01:36] But the legal systems already made up its mind. [01:39] And two people are now serving time related to one of the sickest, most twisted, premeditated plots ever. [01:47] I've ever heard of. [02:01] Music [02:32] After that odd 911 call came in, the dispatcher in Fairfax County, Virginia, tries calling the number back. [02:41] But no one answers. [02:42] And because it came from a cell phone, they can't pinpoint where to send police. [02:47] So they're kind of just stuck. [02:49] until 15 minutes later when the same phone number calls back. [02:54] And this time, a frantic young woman is on the line.

[02:58] I need any help. My friend, she just was stuck in the neck now. She's bleeding a lot. I don't know what to do anymore. Okay, where are you located? Okay. [03:11] What's your address? [03:14] Take a deep breath for me. Just let me know your address. [03:22] I'm [03:24] Thank you. [03:27] One, two, three. [03:31] - Okay, one three. - One three. - One three. - Okay, one three. [03:37] Shake a deep breath for me. You're on Stablebrook Way? [03:43] Are you on Stablebrook Way? [03:47] - Yes, what's your health number?

[03:50] It's-- [03:52] And I, um, [03:55] I am... Okay. Is there somebody else there that can give you the address? [04:04] Thank you. [04:12] - Okay, and what's your name and what's going on? - My name is Brennan Banfield. I'm a federal agent, this is my house. There's somebody here. [04:22] I... [04:24] I shot him. [04:25] but he stabbed her. [04:29] She's bleeding. She's got several marks on her neck. What do I do? Okay. So what I need you to do is apply direct pressure directly to where she's bleeding from, okay?

And if it becomes soaked, just add more cloth to what's already there. Okay. [04:45] How old is the person? [04:47] I don't know. [04:49] the person that's bleeding. [04:52] - 37. - Okay. [04:55] Thank you. [04:55] Thank you. [04:56] Thank you. [05:01] Okay, so the person that you shot, where is he? [05:04] - I don't know. I don't know him. - Okay, where is he though? [05:09] He's here, he's on the ground. [05:12] Thank you. [05:14] Thank you. [05:15] Okay. [05:17] Okay. [05:19] And the person that he stabbed, where are they now?

Are they still in that room? I have a question coming to you. [05:27] EMS and Fairfax County police head to the Banfields' home. [05:30] a large brick-front colonial tucked into a quiet cul-de-sac. [05:34] in the C. suburb of Herndon. [05:37] They're let in and led upstairs by the family's au pair. She is who called 911, and she directs them to the main bedroom, where they see the bed is stripped with bloody linens on the floor. [05:49] Two guns are on the bare mattress and Brendan is kneeling on a towel beside the bed next to his naked wife.

[05:55] 37-year-old Christine Banfield. [05:57] And he's using his bare hands to stop the bleeding that's coming from stab wounds in her neck. [06:03] and lying atop a dog bed against the bed frame, the officers see the stranger that Brendan said he shot. [06:10] Under the dog bed by his head, they find Christine's underwear ripped at the crotch. [06:15] And nearby is what's believed to be one of her shirts with a jagged cut down the back. [06:21] Now, paramedics go to each person, but the man is already beyond saving. [06:26] There's still hope for Christine, though.

She is breathing. [06:29] So EMS rushes her to an ambulance waiting outside while responders inside try to get a handle on this chaotic scene, including tending to Brendan, who seems unable to even stand on his own. [06:52] Stay with Sergeant. I'll just do a walkthrough, okay? Okay. We're gonna have to get him out of here. Yeah, I know. Can you give him a second? Don't put anything else in the gun. I'm not. Let me change my gloves up. We can get him out of here. Knife's there. Guns are on the bed.

[07:14] Right here, the officer standing closest to Brendan mouths in the direction of the body cam. [07:19] He doesn't know. He says it twice, but it's not totally clear what he means because he's [07:24] Christine was still alive at the house, so it's not like he's saying he doesn't know that she's passed. But, I mean, it's possible that anyone with medical training would know that her injuries were bad, likely not survivable. [07:45] So if we can get you outside, can you... [07:47] You got a little fun. [07:49] Can you help him?

Just be with him? [07:51] Thank you. [07:51] - I'm gonna go on the bed. - Alright. [07:57] - I'm gonna go down. [07:59] Whenever they called us. Whenever, what's your name? Brendan. Thank you. [08:06] What did you say? This is Vienna? Easy. Sorry, say it again. So are you with Vienna? My office is in Vienna, correct. Did you call my office? No. I need to call my manager. I got some point. [08:22] It's the least of our words right now, man. [08:25] We're just going to get you in a cruiser outside in the air where you can breathe.

[08:29] Brendan is escorted out to his front lawn. They want to get him in an ambulance to make sure that he's not injured at all. [08:36] He's limping a little, but he says he doesn't know what's wrong. He seems to just kind of be... [08:40] in shock as he hangs his head and stares at the ground. [09:10] Okay. All right. So you're not hurt anywhere. Is that not your blood, correct? I think it's... All right. Do you want to slip this jacket off for me so we can evaluate you real quick?

[09:21] They check him out, but Brendan... [09:23] is basically physically unharmed, although he thinks maybe the stranger struck him once. [09:28] But when they get to the hospital, he overhears someone talking about his wife, Christine. I just didn't see him in the bedroom. [09:37] I didn't hear what you said, sir. Yeah. [09:42] God, I can't stop probably and be supposed to have a good one. [09:45] Thank you. [09:45] Can you have someone check with him again? No. What is the nature of the incident? Okay. [09:49] Check what? The status of his wife, huh?

[09:53] Hi, sir. My name is Gina. I'm one of the doctors here. Your wife has died. [10:00] Thank you. [10:03] The doctor stays with Brendan as he cries. [10:09] And she offers to try and answer any questions he has. [10:20] You were there and it sounds like there was a lot of blood loss. [10:23] So I think that she died of blood loss. [10:27] Her airway was actually okay. I'll call the medical examiner, of course, and we'll do an autopsy and make sure we know for certain. [10:40] I mean, those were enormous wounds, and the neck is not compressible, so it's not possible really to stop all the blood loss.

And her airway, it seems like, was in the midline okay. She was able to be intubated. Everything that was possible to be done was done for her right away. You did a wonderful, you know, you did everything that was possible. [11:03] It's not a survivable injury. [11:08] Brendan had just turned 38 the day before this. [11:12] Now he's a widower and a single dad to his and Christine's four-year-old daughter. [11:16] Police want to give him some space, but they need to know what happened. [11:21] Except Brendan isn't just going to be an open book.

Like, I don't know if you caught it on the 911 call, but he said that he was a federal agent. Oh. Works for the Internal Revenue Service, IRS, Criminal Investigation Division. [11:33] He knows the life rule that we preach. [11:36] Always get a lawyer right. [11:38] He has already given a little bit of information, like, [11:41] kind of jumbled in the 911 call and a little bit to first responders. Basically, what they put together is that an intruder was attacking his wife. He shot the intruder and he confirms that the two guns that were sitting on the mattress were his.

But that is about all he's ready to say. [11:57] Police aren't totally in the dark, though, because while Brendan was at the hospital, the family's au pair and the Banfield's little girl, who she nannies for... [12:07] or at the police station. [12:08] Her name is Juliana Perez Magalianes, a 22-year-old Brazilian woman who came to the S. through an au pair program nearly a year and a half prior, like back in October of 2021. [12:21] And since then, she had been living with the Banfields, caring for their daughter. [12:25] Tell me about the family.

Oh, I don't have anything to complain about them. They are amazing. They're always amazing. [12:36] The sweetest ever. They always treat me really well as a family. We always did things like family. [12:48] What about the relationship between mom and dad? [12:51] Oh, they are really good with each other. They are super stable. I never seen anything disgusting or anything. [13:00] It's deposit. They are super... I don't know how to say it. Super... They get along well. They're friendly. You don't see them fight very often? No. I never seen them fighting.

Never seen them fight? No. [13:16] There at home, everyone is calm and we talk, we don't yell, we don't have fights, we never do. [13:27] When you say fights, do you mean yelling fights or physical fights? Yeah, yelling or fights. Yeah. I've never done it. So you never know or physical? No, never. [13:35] I've heard two things. [13:38] Juliana tells police that Friday was supposed to be a normal day. [13:42] Brendan had left for work early, and Christine planned for Juliana to take their little girl, [13:46] to a zoo in

C. It opened at 8 m. So they headed out at around 7.20, 7.30 m. [13:54] But before they even left the street, Juliana realized that she had forgotten their lunches. So [13:59] She was just going to run back in. [14:02] But then she saw an unfamiliar gray Jeep pull into the driveway like before she could. [14:08] And a man that she had never seen before parked there. [14:11] got out carrying a backpack or something, [14:14] and walked inside like he owned the place. [14:17] Now, she said she tried calling Christine, who was still inside, but it went straight to voicemail.

So that's when she called Brendan, who was at a nearby McDonald's. [14:24] He tries calling Christine, too. Same thing. Got her voicemail. [14:28] So he came home and all three went in together, Juliana, Brendan and the little girl. [14:34] Now, Juliana said that she heard a slapping or like a spanking type noise upstairs. So the two adults told the four year old to stay in the basement while they went up to investigate. [14:45] But by the time they got upstairs, [14:47] What she says they walked in on... [14:50] was a shirtless man over a naked Christine on the floor.

[14:55] And before she even fully realized what was happening, Brendan was standing in front of her in the doorway with his gun, like his service weapon drawn. [15:03] And they were yelling to each other, didn't really understand what they were saying, it was too fast. And Brendan said, "Drop the knife, please drop the knife." That's what I heard. [15:17] that [15:17] It's like I was saying, [15:19] drop the gun, drop the gun, and they were [15:22] Yelling children and he... [15:25] the guy [15:26] And he said like, [15:28] Drop the gun, I'm gonna kill her.

[15:31] He had... [15:32] and [15:34] When he said that I [15:36] was [15:40] For me it didn't I didn't believe that somebody was going to do that I was I [15:46] Okay. [15:48] And I don't know why... [15:51] He did. I can't... [15:53] When it started, I... [15:55] kind of-- [15:55] I... [15:56] Cover my ears. [15:59] I closed my eyes. I didn't want to see or hear anything because they were [16:05] getting serious I guess like he was saying I'm gonna kill her [16:10] He kept saying that. [16:16] Then he...

I didn't want to say that, but he started stabbing her with the knife and... [16:25] When I saw that, I just... [16:27] closed my eye [16:28] I never seen that. [16:31] what's happening, then I... [16:35] Brendan shot him. [16:42] And... [16:43] I was even more scared. [16:46] She says Brendan then told her to go open his safe and grab his other gun so that she could be his backup while he helped Christine. [16:54] Now, Juliana knew how to handle a gun because Brendan had taken her to a shooting range before, so...

[16:59] She did what he asked. [17:12] He was reacting, so he was going to do something with Brendan also. [17:18] And then I shot him also. [17:20] I did. [17:22] Detectives knew there were two shots to their male victim. [17:27] One in the head [17:28] One in the chest. [17:30] And they knew there were two guns found on the bed. [17:33] This is the first time that they get confirmation that both Juliana and Brendan shot this guy, basically to stop a threat, as Juliana put it. [17:43] But they didn't actually stop it.

[17:46] Christine had been stabbed in the neck six times. She had even more cuts on her neck and shoulder, bruises on her arm and hand and legs and chin. [17:56] and an abrasion on her wrist, possibly from being restrained. [18:00] And it looks like the male victim had come with both restraints and intentions. [18:05] His pants are undone, and he has a backpack with him. [18:09] In that backpack, police find zip ties, chains, padlocks, clothespins, electrical tape, saran wrap, a gag lube, and strangely, a single apricot. [18:21] Okay, but I mean, the timing alone, he had to have been like lying in wait for Juliana's leave.

You would think that, right? Because everything happened so quickly. Yeah. But they're actually able to identify this guy from his car and his cell phones as 39-year-old Joseph Ryan from nearby Springfield. [18:37] And in his wallet, they also find a receipt from Walmart, timestamped 713 that morning, [18:44] And that had just three items on it. So toothpaste, the same lube that was in his backpack, [18:48] and apricots. [18:50] Based on that drive from Walmart, the earliest that he could have arrived at that house is 725. [18:55] So he's at the store before this, not stalking the house.

[18:59] And if this... [19:00] was some highly planned attack. [19:03] Why does it seem so amateur? I mean, he did nothing to hide his identity. [19:08] He parked his Jeep right in the driveway. His wallet is there in the room. And Brendan and Juliana didn't know him at all. Not that anyone can tell. [19:17] But there are other reasons that this just doesn't sit right. [19:22] as a random crime. [19:23] I mean, this is an affluent, low-crime neighborhood in general. [19:27] There are no signs of forced entry to this house.

And the house has a smart lock system. [19:32] that [19:33] As far as they can tell, no one tampered with. [19:36] So how would this guy have gotten in [19:38] unless someone from the house let him in. [19:42] Unfortunately, the only people that they can't ask about this are... [19:47] Joe and Christine. [19:48] But they do have their phones. [19:51] Now, they find Christine's downstairs in the drawer of this bar cart that's like pushed up against the wall. [19:57] And Joe's is right there in his Jeep. [19:59] Now on Christine's phone, they see one of the open apps is the smart lock system, showing that the front door lock had been disabled.

[21:16] It turns out that Joe had been messaging someone called Anastasia9 on FetLife, which is this social networking site for people into BDSM and kinks. [21:28] And Anastasia Nine appeared to be Christine. [21:32] At least based on the profile selfie pic of her in a bathing suit. Just her body, no face. [21:36] Now, she described herself as a married woman who cheated before, whose husband was too gentle for the rough role play that she craved. [21:44] She wanted an aggressive don. [21:46] No dates, no coffee, just sex. [21:49] Anastasia Nine and Joe had started talking back in late January, but they'd recently moved their conversations to an encrypted network.

[21:56] app and actually planned an encounter. [21:59] basically a violent fantasy where she would play a sleeping woman. [22:03] And Joe would play an intruder who forces himself on her. [22:07] Now, they picked that Friday because Anastasia Nine said that her husband was going to be out of town. [22:12] and her instructions were specific. [22:14] Come over at around 7.20, [22:17] Park in the driveway, [22:19] leave your phones in your car. The door is going to be unlocked. My dog is going to be put away in the basement. [22:24] He was to come upstairs, pin her down, restrain her, cut her clothes off with a knife, blindfold her, and gag her.

[22:32] Anastasia Nine had even asked Joe for a photo of everything he was bringing, including pictures. [22:38] A knife. [22:39] It's the exact one detectives found in the bedroom. [22:43] the same one used to kill Christine. [22:46] Everything police were being fed fit together neatly. [22:49] This woman, married to a federal agent, [22:52] was living a double life. [22:54] She invited the wrong man into her home and into her bed, and she paid the ultimate price. [22:59] Her husband was so close to being the hero, but he just couldn't save her in time.

[23:05] except for every part of the story that makes sense. [23:09] There are 10 that don't. [23:11] I mean, take Joe. [23:13] Like, what on earth is his motive here? [23:15] The communications had made it clear that there wasn't some, like, ongoing affair. As far as Joe seemed to be concerned, this was supposed to be just, like, [23:23] Two adults meeting up for a first-time encounter, [23:26] What the hell happened? [23:28] He doesn't seem like some violent guy who got carried away. [23:31] When they dig into his background, the man that they discover doesn't match the scene that they found him in.

[23:36] I mean, he had some criminal history, but like nothing major. [23:40] And while Joe didn't have a spouse or kids, he was devoted to the family he did have. [23:45] His grandparents raised him and when they got older he became one of their primary caregivers. [23:51] He was at his mom's side through cancer treatment. [23:54] Loved ones describe someone compassionate and kind. [23:58] I mean, people are more than one thing. And Joe also had an interest in BDSM and rough sex role playing. [24:06] which he tried to engage in responsibly.

[24:09] You can see it through his chat history with Anastasia Nye. [24:13] Since the plan involved gagging her, Joe set up a nonverbal stop signal and asked about her boundaries so he wouldn't overstep. [24:21] Our reporter, Nina, even spoke to a former partner of his, and she told us that [24:25] During the Me Too reckoning, Joe contacted this person to make sure nothing about their experiences was bothering her even in hindsight. [24:32] And it wasn't, but, I mean, he was mindful about it. Exactly. [24:36] Now, as far as we know, he didn't have any other encounters that got out of hand or instances where he just like, [24:43] snapped like that wasn't him.

[24:46] End. [24:46] None of this was like Christine. [24:50] Everyone agrees that she was a devoted nurse, mom, wife. [24:54] And not like a mom can't have a kink, but like as far as they could tell, Christine had never even been unfaithful. [24:59] I mean, they check years worth of her data. I mean, back to the mid 2000s, [25:05] There is nothing, no flirtations, no affairs. [25:08] Not even like mainstream porn, let alone anything in Anastasia 9's wheelhouse. So this would have been like a real zero to 60 for her.

And of all things, to have some sexual assault fantasy, [25:20] It makes even less sense when you realize that she had spent her career doing some of the hardest work in medicine. [25:26] She was a pediatric ICU nurse when she died. But before that, she was a sexual assault nurse examiner. Oh, my God. Then, no. That's what I'm saying. I cannot imagine a world where you work with people who have been the victim of sexual assault. [25:41] See firsthand the trauma of that, the brutality of that, the way that it can destroy people.

[25:47] And then we're supposed to believe that, like, [25:50] That's the fantasy she lands on. Like... [25:52] Her first time ever cheating on her husband, and this is how, like, she's going to have a good time on a Friday morning at 720, like, with some stranger. [26:01] And like, listen, don't anyone dare come for me like I'm king shaming like this was not her kink. And that is what becomes painfully obvious when police look at her life. [26:11] as a whole. [26:12] Christine Banfield. [26:14] and Anesthesia 9. [26:16] Do not feel like the same person.

[26:18] Detectives go on an all-out digital blitz, pulling terabytes of data off dozens of devices. [26:26] And piece by piece, they start to rebuild the life of this Anastasia 9 account. [26:33] They also build out a portrait of everyone who lived in the Banfield House. [26:37] But before... [26:39] They even do. [26:40] There are hints... [26:42] about what they're going to find. [26:44] As Fairfax County Detective Thomas Goodell told us, [26:48] There were red flags from the beginning. [26:51] The rehearsed sounding law enforcement lingo that Juliana kept using when she talked about what happened.

[26:58] She had to stop. [26:59] A threat, remember? [27:01] He got the vibe like she had practiced that story. [27:04] So investigators started asking hyper-specific questions. [27:09] about body positioning. [27:10] Where was the man's head, his hands, the knife? [27:13] And what Juliana ultimately described is a man... [27:17] who was defenseless by the time she shot him. [27:20] I mean, the way she tells it to them, he was partially like on his back moaning. [27:26] The knife wasn't even near him. It was on the floor away from him. [27:30] That means that the shot she fired could be considered murder.

[27:35] They could have charged her right then and there. [27:39] But they didn't. [27:40] Instead, [27:41] they begin collecting their mountain of evidence, while at the same time, [27:47] Keeping an eye on Brendan and Juliana, who are staying in a hotel since the house was a crime scene. [27:54] And interestingly, [27:55] that very first night when they go to the hotel. [27:59] There is this undercover officer in the lobby who overheard something that stopped him cold. [28:06] Brendan's daughter... [28:08] Ask Juliana two questions. [28:10] Can she call her mommy now?

[28:12] And is Juliana going to marry her daddy? [28:15] The first answer is yes, she can call her mommy. [28:18] As for marrying her daddy, [28:21] Juliana says. [28:22] I wish. [28:23] Now, [28:24] In her interview with police, Juliana had described her relationship with Brendan as strictly professional. [28:31] But like... [28:31] Shout it. [28:32] Because [28:33] On Juliana's phone, detectives find a trove of photos documenting her relationship with Brendan. [28:40] In sum, she slapped an emoji sticker on his face, but it's like undeniably him. [28:46] Friends she'd sent them to confirm.

[28:48] Juliana and Brendan had been involved since summer 2022. Was Christine suspicious at all that something like this was going on? Unlikely. Like she and Brendan had been together since college. They'd been married nearly like 13 years. [29:00] He had actually cheated on her before, like this long-term affair that she had learned about that sent them to counseling. [29:07] But they stayed together. [29:09] And on paper, they worked through it. [29:12] However, police learned that Brendan had other affairs that Christine likely never knew about. [29:19] And that probably includes Juliana, because Christine recently encouraged her to extend her au pair contract.

[29:25] A friend of Christine's told us that she actually thought Brendan and Juliana's dynamic [29:29] was cute. Like, she thought they had a big brother, little sister thing. But like, obviously, that's not true unless this is Game of Thrones. And it seems like she was completely in the dark about what was happening right under her nose in her own home. [29:43] And that home... [29:44] is where investigators began to trace the creation of the Anastasia-9 FetLife account. [29:51] It started with a brand new Gmail account being created in early January.

[29:57] Then on January 17th, that email registered the Anastasia 9 FetLife profile. [30:03] That same day, Christine took that bathing suit selfie and, [30:06] and sent it to... [30:08] Her husband... [30:09] And within a few days, the Anastasia 9 account was chatting with multiple other FetLife accounts, telling them she had a sexual assault fantasy. [30:18] But over and over, there was a blocker. [30:21] every guy wanted to meet in person first. Like it's too dangerous not to, right? Like, [30:27] It could be anyone behind that keyboard. [30:30] But there was one person who agreed to forego the face-to-face meeting.

[30:34] And that was Joe. [30:36] Now, [30:37] This had to have seemed risky to him because he kind of tried to arrange an in-person meeting first. But. [30:43] In the end, he settled for a long late night call through an app three days before the murders. [30:50] Maybe that call put him at ease. [30:52] But there's no recording, so we may never know. [30:56] What we do know is that Joe and Anastasia Nine were still working out the details Thursday night, February 23rd. [31:04] Early the next morning, [31:06] Friday. [31:07] at 547

m. [31:09] Christine's phone was used to disable the front door lock. [31:13] About an hour later... [31:15] her phone gets shut off. [31:17] But the conversation with Joe kept going from Christine's laptop. [31:23] He said that he was running behind. [31:25] At 6.48, Anastasia Nine sent a final reply. [31:29] Okay. [31:30] I'll be waiting for you. [31:32] And what's wild is, [31:34] is over the course of weeks, at the same time that the FetLife account stuff was being accessed or used from her laptop, [31:43] her phone was doing like completely ordinary things, shopping for scrubs, researching vacations, looking up TV shows.

I mean, that doesn't sound like [31:52] two sides of the same person that sounds like two completely different people. Especially when police find out Brendan and Juliana... [32:00] took trips together. [32:01] And each time that they were gone, [32:04] The FetLife account. [32:06] would go dark, even though Christine was home with her devices. And you'd think that this would be like the perfect time for her to be accessing that account. If you're going to have a liaison with a stranger, do it while your husband is away, rather than while he is just like grabbing breakfast at McDonald's.

Yeah. On top of that, not long before the killings, Brendan and Juliana both got new phones and iCloud accounts set to sync almost nothing. [32:31] Like their old cloud accounts were wiped clean. [32:34] So investigators quickly land on a theory. [32:39] Brendan and Juliana. [32:41] did not interrupt a home invasion. [32:44] they orchestrated one. [32:46] Using a fake online persona to lure Joe to the house [32:50] Then they killed him, [32:51] and Christine and staged it so that Joe would take the fall, which is diabolical. Well, it is also so convoluted [33:00] That when police lay it out for prosecutors, the reaction is basically like, [33:05] No way.

[33:06] I mean, don't get me wrong, they were suspicious, but... [33:09] When we spoke with the Commonwealth's chief deputy, Jenna Sands, she told us that at the time it seemed more likely to them [33:17] that Christine and Joe were having an affair, and Brendan and Juliana walked in on them and killed them. I mean, how? [33:25] That was the Occam's razor version, I think. Like the whole catfishing thing is just so overcomplicated. [33:33] And digital evidence has limits. Christine was always in the house with Brendan and Juliana or both like when the account was active.

So they can't. [33:42] prove who was using any given device. [33:46] They needed more. [33:48] But when you're talking this much forensic evidence, [33:51] More takes time. [33:53] And since prosecutors don't think that there was like a public threat, the priority is [33:58] was getting it done right. [34:00] not fast. [34:01] But Fairfax Police Chief Kevin Davis told us that the department was keeping close tabs on the Banfield family the entire time. [34:10] So, [34:11] They got to watch as Brendan, his daughter, and Juliana move forward. [34:16] right back into the house where Christine and Joe were killed, along with Brendan's mother, who becomes...

[34:21] Kind of like his mouthpiece while he stays quiet. [34:25] The problem, though, is after a few months, [34:27] they start to worry that Juliana and Brendan are a flight risk. They see that Juliana has applied for a new Brazilian passport to replace the one that they confiscated. And Brendan started... [34:38] learning Portuguese. [34:40] But Juliana is, I think, the bigger concern because Brazil generally won't extradite its own citizens. If she makes it home, they might never get her back. [34:50] So they decide to roll the dice. [34:51] And in October 2023, they decided to charge Juliana...

[34:55] with Joe's murder. Why just Joe? Well, because that's what they can prove. Like in her initial police interview, she admitted that he was incapacitated when she shot him that second time. [35:07] And according to the medical examiner, that second shot is the one that killed him. Although, I mean, the first shot that Brendan fired at a downward angle, by the way. [35:16] could have been fatal as well. [35:18] Now, don't get me wrong. They think that there's way more to this story. But this is like the surefire, solid choice.

This is what they have. This is what they know they can use to hold her. [35:26] They're in for another shock, though, when they make the arrest and go back into the Banfield's house with a search warrant. [35:34] Christine has essentially been erased. [35:38] Her photos are gone from the bedroom, replaced by pictures of Brendan and Juliana together. Her clothes are gone from the closet. Her clothes are gone from the closet. [35:45] I mean, [35:46] Julianas are hanging in their place. Are they sleeping in the room where Christine and Joe died?

Like the bedroom? Christine who is the vibe. Yes, they are. Oh, my God. And her arrest only makes it clearer how interesting. [36:00] deep she is in with Brendan. [36:03] Once she is sitting in jail, they are monitoring all her communication. Yeah. Obviously. Letters, emails she's exchanging with Brendan, exchanging with his mom, her loved ones in Brazil. [36:14] She and Brendan are planning for the future at this point, planning a family of their own. [36:20] All while Brendan's mother is funding Juliana's legal defense. [36:25] I love my kids, but how is his mother supporting this?

I don't know. It seems so toxic. [36:31] And listen, I kept looking for the thing like... [36:33] Oh, like, did Christine's friends hate this guy? Like, was Brendan abusive? Like, there had to have been signs, right? [36:41] In this case, [36:43] "'Not really.' [36:44] I mean, he was actively cheating. We know that. But, like, I think he hit it well. No one in Christine's life so far has been like, [36:51] Oh, I always had a bad feeling about that guy. [36:53] If anything, Brendan barely registers for most people. His co-workers don't seem to like him much, but not because he's threatening.

He's just sort of like... [37:01] They're easy to forget. [37:04] I mean, Fairfax Commonwealth's attorney Steve Descano referred to him as a walking saltine. But he's mommy's saltine, and I imagine she will do anything to protect him. So... [37:17] As prosecutors gear up, [37:19] Investigators go back to the beginning. [37:22] Problem is... [37:24] They know the crime scene was compromised almost immediately. First responders were trying to save Christine, checking Joe's vitals coming and going. [37:33] The knife was stepped on and kicked. [37:35] It was chaos. [37:37] But luckily, they have body cam footage, which they go through frame by frame.

[37:44] And the more they look at Joe, the harder it is to believe he did what Brendan and Juliana say he did. [37:51] I mean, one of his legs was wedged so far under the bed frame that responders struggled to pull it out. [37:57] His hands were like folded neatly across his chest, like what detectives call a funeral pose. [38:03] And when an officer lifted Joe's top hand to check for a pulse, [38:07] A swath of his skin underneath and in between his fingers [38:11] were clean. Like there was no [38:13] Blood.

[38:14] And that only makes sense if Joe's hands were already folded when blood landed on them. Not like he was in the middle of a frenzied knife attack. Yeah. And blood patterns tell a story. [38:26] Joe had small round drops on his chest and arms that looked like they fell straight down when he was lying still. [38:33] But Brendan's clothes... [38:35] Tell a different tale. I mean, those stains are longer and messier the way blood lands on someone who's moving while blood is flying through the air. [38:44] Bottom line? [38:45] The blood on Joe doesn't point to him as the stabber.

[38:50] The blood on Brendan. [38:51] does. [38:52] And when testing confirms that, [38:55] prosecutors, [38:56] finally have what they need. [38:59] So in September 2024, [39:01] almost a year. [39:03] After Juliana's arrest, [39:05] They finally charge Brendan with Christine and Joe's murders. [39:09] and ultimately with felony child abuse and cruelty since his daughter was home when it happened. [39:16] Now, this whole time, Julianna's been away forever. [39:19] She has not flipped on him. [39:21] I think she was probably telling herself that cops didn't know the full story, right? Like, otherwise, they would have arrested him.

[39:28] But now that he's in a cell too, [39:30] It's all crashing down. [39:32] Plus, he stops communicating with her after he's arrested. [39:36] And she'd also been reading discovery files for her upcoming trial, which detail... [39:41] all of the affairs that Brendan had while he was with Christine. [39:46] at least all the affairs that they knew about. [39:49] And she'd likely known that he'd cheated before her, but I doubt she knew how much. [39:54] And now she is probably no longer feeling special. [39:57] She's feeling used. [40:00] So Juliana agrees to plead guilty to involuntary manslaughter.

[40:04] and testify against Brendan. [40:07] In exchange, prosecutors will recommend... [40:11] Time served. [40:12] Time served, like the time that she's been in since they first arrested her. That's what, like a year? Yeah. [40:18] Well, I mean, by the time they actually get to Brendan's trial, it's going to be a little bit more than that. [40:22] But they need her. They need her to help lock down the case against Brendan. That's what her testimony will do. [40:29] So... [40:30] that October. [40:31] She gives them... [40:32] A full account of what she says happened.

[41:44] - According to Juliana, the murders of Christine Banfield and Joe Ryan [41:48] weren't impulsive. [41:50] Planning started in October 2022, when she traveled with Brendan and his daughter to

[41:55] to New York to visit his family. I think Christine had to stay back and work. [41:59] They had been involved for a few months by then, and Brendan mentioned wanting to get rid of his wife. [42:05] He told Juliana that Christine was a bad mom who didn't care about his needs. [42:10] But a divorce would mean custody battles, child support, [42:14] In his mind, killing her would just be easier. [42:16] He didn't want to hire a professional. He was worried about the money trail. So instead, he came up with something interesting.

[42:23] Far more elaborate. [42:24] Create a fake profile on a fetish site, pose as Christine, and lure a man to the house under the pretense of a violent sexual fantasy. [42:33] They would frame that man for Christine's murder, and Brendan would get to play this [42:38] heroic husband who tried to save her. How did he even... [42:42] Think of something like that. Well, Juliana says she doesn't know where he came up with the idea. [42:47] But Chief Deputy Sands later learned that it mirrors the plot of a TV show, The Closer, Season 1, Episode 6, for anyone interested.

[42:55] And I don't know if Brendan ever saw it. [42:57] but I watched it and [42:59] the similarities are hard to ignore. [43:03] And as Juliana lays it all out... [43:05] details that never made sense before finally start to like click into place [43:11] Even the things that once meant nothing take on new meaning. [43:14] Like... [43:14] Months before the murders, the Banfields got new windows installed. [43:18] Police figured that's just like a routine house renovation thing. Yeah. Whatever. Whatever. [43:22] But Juliana says that Brendan upgraded to triple-pane near-soundproof windows.

[43:29] then tested them by standing in the bedroom and screaming while she listened outside. [43:35] Even the windows were planned to make sure nobody would hear her. [43:39] Brendan was so meticulous about the digital trail, too. I mean, they only used Christine's devices when she was home so that everything would be traced back to her location. Yeah. [43:51] Juliana says she was the one who did the long call with Jot to get him comfortable before the meetup. [43:57] And he commented about her having an accent because like, [44:00] I mean, the picture he saw was of a white American woman.

[44:03] What? [44:03] It obviously didn't scare him off because a few days later he showed up. [44:08] That morning, Christine was sleeping in with her daughter since she had the day off. [44:14] Brendan brought the little girl downstairs. [44:17] handed Juliana his second gun, which she slipped into her hoodie pocket, [44:22] They disabled the front door lock with Christine's phone. [44:25] powered the phone off, and stashed it in that bar cart drawer. [44:29] Then Brendan drove to McDonald's while Juliana settled his daughter in the car. [44:34] Parked by the house?

[44:36] She waited. She watched Joe pull in. [44:39] That's when she called Christine's dead phone to create a record of her trying to warn her. [44:44] And then she calls Brendan and tells him to come home. [44:47] And according to Washington Post reporter Tom Jackman, this... [44:51] Whole time. [44:52] They put on a show for Brendan's daughter so that she would repeat it to police later. Like, oh no, we forgot the lunches. Look at that strange man going inside. [45:02] When Brendan got back, they went in through the basement. [45:06] left his daughter downstairs and headed up.

[45:09] And in the bedroom, Christine was on the floor with Joe behind her, and she yelled something like, Brendan, he has a knife. [45:16] And like when you think about what this must have been like for Christine, she woke up to a stranger with a knife trying to sexually assault her. A man who believed that her fear was fake, just like part of the fun. [45:30] Joe is inside for at least five minutes, probably more, before Brendan and Juliana came in. So she is, Christine, she is fighting hard, which explains the sheets being ripped off the bed and her bruises.

[45:41] But importantly... [45:42] This is the thing to focus on. [45:44] She has not been stabbed yet. [45:46] Then, Brendan walks in. Which, in that moment, Christine must have felt... [45:50] So much relief. Right? Like her husband is here. She is safe. Thank God. But that relief was short-lived. [45:58] Brendan shot Joe in the head, and Christine told them to call 911. [46:04] Now, for some reason, Juliana dialed before Brendan gave the go-ahead. [46:09] That is when that first call was made. The one that was just a few seconds where you hear like a moan.

[46:15] But Brendan motioned for her to hang up like it wasn't time yet. [46:19] He told her to go get a towel, then to go to the gun safe, even though she had the gun she needed. [46:24] And then when she came back, Brendan was on top of Christine, stabbing her in the neck. [46:29] Then Joe stirred, so Juliana shot him. [46:32] like she'd been trained to do. Remember, he took her to the shooting range. [46:37] And he'd actually bought that second gun just weeks before everything went down. [46:42] That doesn't feel like it's for protection.

He wanted her to be implicated. More of a reason for her to stay silent. [46:49] She watched Brendan drip Christine's blood onto Joe's body. [46:54] And once the scene was set, [46:56] 15 minutes later, [46:59] This is why she had to hang up the call, right? They're not ready. Once the scene was set, [47:03] He has her call 911 again. [47:05] Detective Goodell noticed something important about this telling of the day. [47:10] Now, unlike Juliana's first interview, which felt scripted and hollow, [47:15] This time, Juliana gives sensory details, Christine's warm blood on her hands.

[47:21] the deafening crack of the gunshot, [47:24] her account [47:25] matches the evidence. [47:27] They finally got him. [47:29] But Brendan is not going down without a fight. [47:33] His defense doesn't just say that investigators got it wrong. [47:37] They say the evidence... [47:38] was read backwards. [47:40] and that nearly every detail used to make Brendan look guilty... [47:44] points just as easily toward Joe [47:47] Anne Christine. [47:49] And I could spend 10 episodes unpacking everything, but I want to walk you through some of the big points of contention. [47:56] Starting with the knife.

[47:58] Joe's DNA couldn't be eliminated from the handle, and Christine's couldn't be eliminated from the blade. [48:05] Brendan's DNA. [48:07] is nowhere. [48:08] Yeah, but Juliana said he was already dripping blood on Joe to stage it. So he was basically controlling where his DNA went. [48:16] Yes, but Joe also had a puncture wound on his thumb, which the defense says could have happened when like a hand slipped down onto the blade like mid stab. We know that like knives can get slippery. [48:28] Brendan didn't have a scratch on him. [48:31] And those blood free gaps between Joe's fingers that I pointed out, according to the defense, that just shows that Joe's hand was like clenched, like shut as he's gripping the knife when Christine's blood got there.

[48:43] Oh, and Christine's blood on Brendan's clothes? [48:46] That's a nothing burger, they say. A husband just trying to help his dying wife. [48:50] While a mix of Christine and Joe's blood on the back of Brendan's jacket shows, they say, that Joe hit Brendan from behind. [48:58] The defense also takes aim at the investigation itself. Key evidence was never tested for DNA. [49:05] major bloodstains in the carpet, the gun safe, [49:09] Even Brendan's personal gun. How does that happen in a double homicide? Well, I mean, the lab decides what gets tested.

[49:16] Some items, I guess, weren't considered useful. Others, like the gun, weren't eligible. [49:22] Still, the defense thinks that adds up to some big unanswered questions. [49:26] But honestly, the physical evidence in this case... [49:29] is the least of the prosecution's worries. [49:32] Because this case sets off an internal shitstorm at the Fairfax County PD.
